Article 2: Contract

2.1 General terms and conditions of sale for placing an order

To be able to purchase a product, the customer must be at least 18 years old and have the legal capacity or, if a minor, be able to provide proof of the agreement of their legal representatives.

All orders placed on the website must correspond to the normal needs of a household.

To verify their registration, prospective customers must accurately complete all required fields on the registration form. The asterisk (*) indicates a mandatory field that must be completed in order for the seller to process the customer's order.

2.2 Contract Conclusion Steps

Suppliers reserve the right to modify a product during its collection. Consequently, with prior agreement reached by phone or email with the customer, www.tots.fr may deliver an item of the same price, slightly different but of equivalent quality. If the customer does not agree, www.tots.fr will fully refund the customer for the products.
In this case, if the customer is not satisfied with the delivered product, they can use the procédure de rétractation.

Article 3: Prices and availability

3.1 Prices and availability

The prices displayed on the website are in euros, inclusive of all French taxes (French VAT and other applicable taxes), but excluding shipping and handling fees. If you are ordering from a country other than mainland France, you are considered the importer of the product(s).
Customs duties, local taxes, import duties, or state taxes may be applicable. These duties and amounts are not the responsibility of Tots. They are your responsibility, both in terms of declarations and payment to the relevant authorities and organizations in the destination country. We advise you to inquire about these matters with your local authorities.

We can accept your orders subject to available stock.
We will inform you of the availability of the items you ordered when you place your order. In the event of a delay in supplying your order, we will contact you to inform you, and you will then be able to cancel or maintain your order.

It also happens that the product is in stock on the website and sold the same day in store; if this results in a shortage, we will notify the customer in order to proceed with either a refund or a change of order.

3.3 Pre-contractual information on legal guarantees of conformity

The decree of December 18, 2014 relating to the information contained in the general terms and conditions of sale regarding legal guarantees provides, in article 3, for a certain formality regarding the legal guarantee of conformity detailed below:

When acting under the legal guarantee of conformity, the consumer:
- benefits from a period of two years from the delivery of the goods to take action;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.211-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to twenty-four months from 18 March 2016, except for second-hand goods.
The statutory warranty of conformity applies independently of any commercial warranty that may be granted. The consumer may choose to invoke the warranty against hidden defects in the item sold, as defined in Article 1641 of the Civil Code, and in this case, may choose between rescinding the sale or obtaining a reduction in the sale price, in accordance with Article 1644 of the Civil Code.

Legal guarantee of conformity for goods

Subsection 1

Consumer rights

Article L. 217-3
The seller delivers goods that conform to the contract and to the criteria set out in Article L. 217-5.

He is liable for defects of conformity existing at the time of delivery of the goods within the meaning of Article L. 216-1, which appear within a period of two years from the date of delivery.

In the case of a sales contract for goods containing digital elements:
1° Where the contract provides for the continuous supply of digital content or a digital service for a period of two years or less, or where the contract does not specify the duration of supply, the seller is liable for defects in conformity of this digital content or digital service which appear within two years of delivery of the goods;
2° Where the contract provides for the continuous supply of digital content or a digital service for a period exceeding two years, the seller is liable for defects in conformity of that digital content or digital service which appear during the period during which it is supplied under the contract.
For such goods, the applicable time limit does not deprive the consumer of their right to updates in accordance with the provisions of Article L. 217-19.

The seller is also liable, during the same periods, for defects of conformity resulting from packaging, assembly instructions, or installation when the latter was his responsibility under the contract or was carried out under his responsibility, or when the incorrect installation, carried out by the consumer as provided for in the contract, is due to deficiencies or errors in the installation instructions provided by the seller.

This warranty period applies without prejudice to Articles 2224 et seq. of the Civil Code. The starting point for the limitation period for the consumer's action is the day on which the consumer becomes aware of the lack of conformity.

Article L. 217-4
The goods conform to the contract if they meet, in particular where applicable, the following criteria:
1° It corresponds to the description, type, quantity and quality, particularly with regard to functionality, compatibility, interoperability, or any other characteristic provided for in the contract;
2° It is suitable for any special purpose sought by the consumer, which is brought to the seller's attention no later than the time of conclusion of the contract and which the latter has accepted;
3° It is delivered with all accessories and installation instructions, which must be provided in accordance with the contract;
4° It is updated in accordance with the contract.

Article L. 217-5.I
In addition to the criteria for conformity to the contract, the goods are compliant if they meet the following criteria:
1° It is fit for the purpose normally expected of goods of the same type, taking into account, where appropriate, any provision of European Union law and national law as well as any technical standards or, in the absence of such technical standards, any specific codes of conduct applicable to the sector concerned;
2° Where applicable, it possesses the qualities that the seller presented to the consumer in the form of a sample or model, before the conclusion of the contract;
3° Where applicable, the digital elements it contains shall be provided according to the most recent version available at the time of conclusion of the contract, unless the parties agree otherwise;
4° Where applicable, it is delivered with all accessories, including packaging, and installation instructions that the consumer can legitimately expect;
5° Where appropriate, it is provided with the updates that the consumer can legitimately expect, in accordance with the provisions of Article L. 217-19;
6° It corresponds to the quantity, quality and other characteristics, including in terms of durability, functionality, compatibility and safety, that the consumer can legitimately expect from goods of the same type, having regard to the nature of the goods as well as to the public statements made by the seller, by any person upstream in the chain of transactions, or by a person acting on their behalf, including in advertising or on labelling.

II. - However, the seller is not bound by all the public statements mentioned in the preceding paragraph if he demonstrates:
1° That he did not know them and was not legitimately in a position to know them;
2° That at the time the contract was concluded, the public statements had been rectified under conditions comparable to the initial statements; or
3° That the public statements could not have had any influence on the purchase decision.

III. - The consumer may not contest conformity by invoking a defect concerning one or more particular characteristics of the goods, of which he has been specifically informed that they deviate from the conformity criteria set out in this article, a deviation to which he has expressly and separately consented when concluding the contract.

Article L. 217-6
When, in the course of the contract, the professional processes personal data, a failure on his part to comply with the obligations incumbent upon him under Regulation (EU) 2016/679 of 27 April 2016 and Law No. 78-17 of 6 January 1978 relating to data processing, files and freedoms, insofar as this failure results in non-compliance with one or more of the conformity criteria set out in this section, shall be treated as a lack of conformity, without prejudice to the other remedies provided for by these texts.

Article L. 217-7
*Conformity defects which appear within twenty-four months of delivery of the goods, including goods containing digital elements, are, unless proven otherwise, presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or the defect invoked.

For second-hand goods, this period is set at twelve months.

When a sales contract for goods containing digital elements provides for the continuous supply of digital content or a digital service, the following defects in conformity are presumed to exist at the time of delivery of the goods:
1° For a period of two years from the delivery of the goods, when the contract provides for this supply for a period less than or equal to two years or when the contract does not determine the duration of supply;
2° During the period in which the digital content or digital service is provided under the contract, where the contract provides for such provision for a period exceeding two years*

Subsection 2

Implementation of the legal guarantee of conformity

Article L. 217-8
*In the event of a lack of conformity, the consumer has the right to have the goods brought into conformity by repair or replacement or, failing that, to a reduction in price or to the termination of the contract, under the conditions set out in this subsection.

The consumer also has the right to suspend payment of all or part of the price or the delivery of the benefit provided for in the contract until the seller has fulfilled the obligations incumbent upon him under this chapter, in accordance with the conditions of Articles 1219 and 1220 of the Civil Code.

The provisions of this chapter are without prejudice to the award of damages.*

Article L. 217-9.
*The consumer has the right to demand that the goods be brought into compliance with the criteria set out in subsection 1 of this section.

The consumer requests that the seller bring the goods into conformity, choosing between repair and replacement. To this end, the consumer makes the goods available to the seller.*

Article L. 217-10
The goods shall be brought into compliance within a reasonable period which cannot exceed thirty days following the consumer's request and without major inconvenience to the consumer, taking into account the nature of the goods and the use intended by the consumer.

The repair or replacement of the non-conforming item includes, where appropriate, the removal and collection of that item and the installation of the repaired or replacement item by the seller.

A decree specifies the procedures for bringing the property into compliance.

Article L. 217-11
*The goods are brought into compliance at no cost to the consumer.

The consumer is not required to pay for the normal use they made of the replaced item during the period prior to its replacement.*

Article L. 217-12
* The seller may refuse to comply with the consumer's choice if the requested compliance is impossible or entails disproportionate costs, particularly in light of:
1° Of the value that the property would have in the absence of a lack of conformity;
2. The importance of the non-conformity; and
3° The possible option of choosing the other option without major inconvenience for the consumer.

The seller may refuse to bring the goods into compliance if this is impossible or entails disproportionate costs, particularly with regard to points 1 and 2.

When these conditions are not met, the consumer may, after formal notice, pursue specific performance of the initially requested solution, in accordance with Articles 1221 et seq. of the Civil Code.

Any refusal by the seller to proceed according to the consumer's choice or to bring the goods into conformity must be justified in writing or on a durable medium.*

Article L. 217-13
*Any item repaired under the legal guarantee of conformity benefits from a six-month extension of this guarantee.

If the consumer chooses repair but the seller does not carry it out, bringing the product into conformity by replacing it starts a new period of legal guarantee of conformity for the consumer, applicable to the replaced product. This provision applies from the day the replacement product is delivered to the consumer.*

Article 4: Payment Methods

4.1 Secure payment via CIC

Your credit card payments are processed on the secure server of our partner bank, CIC , and are reinforced with the 3D Secure protocol. This ensures your payment is completely secure, without any banking information being stored on our own servers.

You confirm payment for your order with a code that your bank will send you via SMS. An order confirmation email will be sent to you as soon as your payment is validated by our bank.

If any doubt remains, payment by bank card may be subject to verification by our accounting department.

4.2 Payment by check

Simply print the order form, attach the corresponding check, and mail them to us. The order will only be processed upon receipt and clearance of full payment by check. Payment by bank check is only possible for checks in euros drawn on a bank located in France. The check will be deposited upon receipt. 4.4 Secure payment via PayPal

If you have a Paypal account, you can use it to pay for your orders; an order confirmation email will be sent to you as soon as your payment is validated by Paypal.

Article 5: Delivery Conditions

Delivery times are indicated when placing your order. These times are in business days and exclude weekends. If we experience a supply issue that causes a delivery delay, you will be informed immediately. We will then agree on an alternative shipping date if you maintain your order, or you will have the option to cancel it.

How does the delivery process work?

When your order status changes to "shipped," it means the merchandise has left our warehouse. The carrier is then responsible for your merchandise. The merchandise will be delivered to you at a time agreed upon with the carrier and yourself. If you are not present, please notify the carrier via the link provided and/or by telephone.
Deliveries cannot be scheduled for a specific time but are made within a time slot according to the driver's route. If you miss your scheduled delivery, you will receive a delivery notice to arrange a new delivery date and/or the option to pick up your merchandise at the nearest branch. In this case, you will be charged €35.90, which covers the driver's initial trip and storage fees.

Procedure for receiving your package

A signature is required upon delivery. This signature confirms the conformity of the goods. Once the consumer takes possession of the goods, the risks of loss and damage are transferred to them.

Several scenarios are therefore possible:

  • If your order contains several products but only one is damaged, you must refuse only the broken product and note this on the delivery slip as "refused/broken," along with the nature of the damage and the product's reference or name.
  • If your order contains several products and they are all broken, you must refuse the entire order and note "refused/broken" on the delivery receipt, along with the nature of the damage and the references or names of the broken products.
  • If you wish to refuse your entire order, you must refuse it completely and write "refused" followed by the reason for the refusal, as well as the references or names of the refused products. Please follow this procedure precisely to avoid any inconvenience. Failure to comply with this procedure will invalidate any claim.

No other notation besides "refused/broken" is accepted and will not be taken into account by our insurer. The notations:

You must retain the carrier to check your packages.

Delivery access and shipping

Our carriers deliver orders to the ground floor of your house or building, depending on your type of residence. However, if your address is located in an alley, delivery will be made to the end of the alley; similarly, if the road leading to your address is gravel or difficult to access, delivery will be made to the nearest accessible point.

Article 6: Returns and Refunds

6.1 Right of withdrawal

• What is your right of withdrawal at Tots?

Thanks to the droit de rétractation, vous avez la possibilité de vous rétracter durant les 14 jours suivant la livraison. Vous n’aurez pas à fournir de justifications concernant votre changement de décision, conformément à l’article L.221-23.
Cependant vous devez retourner l’article à votre charge et celui-ci doit être emballé dans le même état reçu avec les conditions suivantes :

- Carton non abîmé et intact
- Produit emballé conformément à l’origine
Le produit doit être remis à la vente et si cela nécessite une intervention de conditionnement de notre part, la reprise vous sera refusée ou vous recevrez un mail pour évaluer la situation.

Vous disposez d’un délai de 14 jours pour nous envoyer le bien après les 14 jours de rétractation.

Tous les autres produits, vendus par la société Tots, peuvent être renvoyés : paroi de douche, receveur, baignoire, pare-baignoire, meuble de salle de bain, vasque, miroir, rangement de salle de bain, WC, sèche-serviette et accessoires. La marchandise doit-être renvoyée dans son emballage d’origine, en parfait état et accompagnée des accessoires et notices (voir article 6.2).

• Quels produits sont exclus de la rétractation ?

Sont exclus conformément à la loi, le droit de rétractation comporte certaines exceptions. ( carrelage, robinetterie, consommables) Les produits sur mesure réalisés et commandés à la demande du client. Les produits en déstockage ne sont pas non plus concernés par la rétractation car ils sont proposés à prix coûtants et de ce fait, nous ne pourrons pas prendre en charge les frais d'annulation. Les produits sur-commande sont les produits qu'on ne stocke pas mais qu'on commande spécifiquement pour le client. Généralement, ils n'ont pas de délais expédiable en 72h.

6.1.1 Remboursement

Tots s’engage à vous rembourser en utilisant le même moyen de paiement que celui utilisé par le consommateur pour la transaction initiale, sauf accord exprès du consommateur pour qu’il utilise un autre moyen de paiement et dans la mesure où le remboursement n’occasionne pas de frais pour le consommateur.

6.2 Retours

• Quelles sont nos conditions de retour ?

Vous êtes dans l’obligation de nous informer de tout retour via votre espace client, dans l’onglet réclamation. Tout colis renvoyé sans avoir préalablement contacté nos équipes ne pourra être pris en charge. De plus, pour exercer votre droit de rétractation, le formulaire (télécharger le formulaire)" doit être obligatoirement joint à votre demande." Vous disposez d’un droit de rétractation de 14 jours ouvrés à partir de la date de livraison, pour nous retourner les articles non souhaités sans avoir à justifier de motif. Aucun retour ne sera possible concernant le produit sur-mesure, la robinetterie, les consommables, le carrelage et la mosaïque mais également les produits abîmés et/ou cassé non déclarer avec le transporteur et au-delà de ce délai.

• How do I return products on the website www.tots.fr?

You have two options:
- Refusal of goods upon delivery:
Retour de la marchandise par notre société de transport. Dans ce cas, le montant réel des frais de retour sera répercuté et de ce fait déduit lors de votre remboursement.
- Vous avez accepté la marchandise à la livraison et vous souhaitez renvoyer la marchandise :
Pour nous la renvoyer, vous choisissez le transporteur de votre choix. Les frais de retour sont donc à votre charge et ne feront l’objet d’aucun remboursement. La marchandise, jusqu'à son arrivée dans nos locaux, est sous votre responsabilité, ce qui signifie que s’il arrive le moindre incident lors du transport, vous devez vous rapprocher de la société de transport contractée afin de gérer le litige.

Une fois le produit réceptionné dans notre entrepôt, celui-ci sera contrôlé par notre équipe qualité et fera l’objet d’une expertise. Après le contrôle effectué, votre dossier sera traité. Si la marchandise reçue ne correspond pas à ce que vous avez commandé, merci de nous faire un message via votre espace client « Messagerie – Nouveau Message – SAV » et d’y joindre IMPERATIVEMENT une photo de la référence indiquée sur le carton et/ou une photo du produit si vous l’avez déballé.
Après contrôle auprès de notre service, la démarche à suivre vous sera envoyée via votre espace client.

6.3 Remboursement

• Sur quelle base êtes-vous remboursé ?

Une fois la marchandise reçue et contrôlée, nous ferons le maximum pour écourter les délais de traitement et de remboursement. Comptez en moyenne une dizaine de jours.

Le remboursement s’effectuera comme suit :
- Déduction des frais de port : votre commande ayant fait l’objet d’un envoi par nos soins.
- Si votre commande a bénéficié des frais de port offerts, nous facturerons le montant réel du coût de l’expédition.
- En cas de refus de la marchandise et donc de retour par nos soins, les frais réels de retour de la marchandise seront déduits de votre remboursement.
- En cas de problème de livraison (adresse incorrecte etc.) vous serez averti par mail ou téléphone. Si nous n’avons pas de réponse dans les 7 jours suivants l’incident de livraison, la marchandise nous est automatiquement renvoyée. Les frais de retour vous sont de ce fait déduits du remboursement.
- Pour toute annulation, 10% du montant du produit concerné, avec un minimum forfaitaire de 15€, correspondant aux frais de traitement et de préparation, vous seront facturés et déduits de votre remboursement.
